Taqadam Terms and Conditions of Use

These Terms and Conditions of Use (“Terms”) govern the way in which all candidates, employers or other users (“You/Your”) may access and use the Taqadam website and its mobile application and/or other Taqadam-related product or service (“Taqadam”). Taqadam is owned and operated by the Qatar Lawyers Association (“QLA”) and is made available to You in accordance with these Terms.
These Terms constitute a binding agreement between the QLA and You, and are accepted by You each time that You use or access Taqadam and its associated services. If You do not accept these Terms, do not use Taqadam. The QLA may revise these Terms at any time by posting an updated version to Taqadam. You should visit Taqadam periodically to review the most current Terms as they are binding on You.
You must be at least 16 years old to visit Taqadam, and, if under the age of 18 You may only use Taqadam under the supervision of a parent, legal guardian, or other responsible adult.

1. Use of Taqadam

1.1. The information and services available through Taqadam are provided for the sole purpose of candidates seeking employment opportunities and career information, and for employers seeking to recruit employees (“Users”), and may only be used by such Users. You may use, print and download content from Taqadam for these purposes only and for no other personal or commercial purpose.
1.2. Access to Taqadam is permitted on a temporary basis, and the QLA reserves the right to withdraw or amend the Taqadam services without notice. The QLA will not be liable if, for any reason, Taqadam is unavailable at any time or for any period.
1.3. The QLA intends to update Taqadam regularly and the QLA may change the Taqadam content at any time. If necessary, at the sole discretion of the QLA access to Taqadam may be suspended or closed indefinitely. The QLA is under no obligation to keep the content current or up-to-date.
1.4. Services and information provided on Taqadam by the QLA are intended to assist in the job seeking and/or recruitment process. The QLA cannot and does not guarantee their prospects of success in any particular case. It is the User’s responsibility to obtain independent verification before relying on information provided on Taqadam.
1.5. All Taqadam content, such as designs, text, graphics, images, video, information, logos, button icons, software and other Taqadam content posted by administrators or the QLA (collectively, “Taqadam Content”), is protected under copyright, trademark and other laws. All Taqadam Content is the property of the QLA or its licensors. Unauthorised use of the Taqadam Content may violate applicable laws and/or applicable communications regulations and is strictly prohibited. It is Your responsibility to preserve all copyright, trademark, and other proprietary notices contained in the original Taqadam Content on any authorised copy You make of such content.

2. All Users

2.1. You understand that all information, data, images, text or other materials submitted, posted or displayed by You on Taqadam is Your responsibility (“User Content”). The QLA claims no ownership or control over any User Content. The QLA reserves the right to refuse to accept, post, display or transmit any User Content in its sole discretion.
2.2. You retain all patent, trademark and copyright to any User Content you submit, post or display on or through Taqadam and You are responsible for protecting those rights, as appropriate. By submitting, posting or displaying User Content on Taqadam, you grant the QLA a worldwide, non-exclusive, royalty-free, transferable, license to use, reproduce, adapt, distribute and publish such User Content using Taqadam. In addition, by submitting, posting or displaying User Content which is available to the general public, You grant the QLA a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content for the purpose of promoting Taqadam and its services.
2.3. You represent and warrant that You have the right to grant, or that the holder of any rights in such User Content has completely and effectively waived all such rights and irrevocably granted to You the right to grant, the license stated above. If You post User Content in any public area of Taqadam, You also permit any User to access, display, view, store and reproduce such User Content for their own personal use.
2.4. You are responsible for maintaining the confidentiality of Your account, User profile (“Profile”) and passwords, as applicable. If You choose to create, or if You are provided with, a User name or number, password, or any other piece of information as part of the Taqadam security procedures, You must treat such information as confidential, and You must not disclose it to, or share it with, any third party. You shall be responsible for all uses of Your Taqadam registrations and passwords, whether or not authorised by You. You agree to immediately notify the QLA of any unauthorised use of Your account, Profile, or passwords.
2.5. The QLA reserves the right to expel Users and prevent their further access to Taqadam for violating these Terms or applicable laws, rules or regulations. The QLA may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for the QLA, or damage the QLA’s or Taqadam’s reputation, brand or public image.
2.6. You agree that You will not:
2.6.1. post, share, distribute, store or destroy material, including Taqadam Content, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the collection, processing, storage, or transfer of personal information;
2.6.2. use any data mining programmes, bots or similar data gathering or extraction technology;
2.6.3. violate or attempt to violate the security of Taqadam or to breach security or authentication measures without proper authorisation;
2.6.4. reverse engineer or decompile any parts of Taqadam;
2.6.5. gather, copy or duplicate in any manner any of the Taqadam Content or information relating to Taqadam, including expired job postings, other than as permitted by these Terms;
2.6.6. post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms;
2.6.7. post any curriculum vitae (“CV”) or Profile, or apply for any job, on behalf of another party or User;
2.6.8. post more than one copy of the same CV at any one time;
2.6.9. access another User’s data or log into a server or account which You are not authorised to access;
2.6.10. post or submit to Taqadam any incomplete, false, misleading, or inaccurate biographical information or information which is not Your own;
2.6.11. post content that contains restricted or password-only access pages, or includes hidden pages or images;
2.6.12. solicit passwords or personally identifiable information from other Users;
2.6.13. delete or alter any material posted by any other User;
2.6.14. harass, or advocate harassment of any group, company, or individual;
2.6.15. send unsolicited mail or email, make unsolicited phone calls or send unsolicited texts, tweets or faxes promoting and/or advertising products or services to any User, or contact any Users that have specifically requested not to be contacted by You;
2.6.16. promote or endorse any illegal or unauthorized copy of another person’s copyrighted work, such as by providing or making available pirated computer programs or links to them, or providing or making available pirated music or other media or links to pirated music or other media files;
2.6.17. use Taqadam for any unlawful purpose or any illegal activity; or
2.6.18. post or submit any content, CV, or job posting that is defamatory, libellous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic or indecent material of any kind, as determined in the QLA’s sole discretion.
2.7. Deliberate violations of system, database, or network security may result in civil and/or criminal liability.

3. No Screening

Users should be aware that Taqadam operates as a platform only and does not introduce or supply candidates to employers (or vice versa). This means that neither the QLA nor Taqadam:
3.1.1. obtains sufficient information for potential employers to select a suitable candidate for an available position;
3.1.2. takes any steps to ensure that it would not be detrimental to the interests of the candidate or the employer for the candidate to fill the available position;
3.1.3. takes any steps to ensure that the candidate and employer are each aware of the legal requirements or otherwise which must be satisfied by either of them to permit the candidate to work in the country and in the available position;
3.1.4. confirms the identity of a candidate or whether they have the experience, skills, training, qualifications or ability to work in the available position or that they wish to undertake the available role;
3.1.5. gives any indication to employers whether candidates are unsuitable (or suitable) for any position to be filled in any circumstances;
3.1.6. proposes candidates to employers or provides any information about them;
3.1.7. takes up any references in relation to a candidate; or
3.1.8. makes any arrangements for the accommodation of candidates.

4. Additional Terms For Employers

4.1. Employers are solely responsible for their postings on Taqadam. Neither the QLA nor Taqadam is to be considered to be an employer with respect to Your use of Taqadam, and the QLA shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on Taqadam.
4.2. You understand and acknowledge that if You cancel Your employer account and/or Profile, or Your employer account is terminated by the QLA in its own discretion, all of Your account and/or Profile information from Taqadam, including saved CVs, vacancy and job descriptions, network contacts, and email mailing lists, will be marked as deleted in, and may be deleted from, Taqadam’s databases and removed from any public area of Taqadam.
4.3. In order to protect Users from commercial advertising or solicitation, the QLA and/or Taqadam reserve the right to restrict the number of e-mails which an employer may send to Users.
4.4. You shall use Taqadam and Your associated Profiles in accordance with all applicable privacy and data protection laws.
4.5. Job Postings
4.5.1. Job postings may not contain:
a. any hyperlinks, other than those specifically authorised by the QLA;
b. misleading, unreadable, or hidden keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined in the QLA’s sole discretion;
c. the names, logos or trademarks of unaffiliated companies;
d. more than one job or job description in a single post; or
e. inaccurate, false, or misleading information.
4.5.2. A job posting may not be used to:
a. post jobs or other advertisements for other employment platforms or post jobs or other content that contains links to any site competitive with Taqadam;
b. promote or advertise career fairs, job fairs, hiring events, conferences, seminars or open houses or any other event or meeting;
c. sell, promote or advertise products or services;
d. post jobs that do not comply with applicable local, national and international laws, including but not limited to laws relating to labour and employment, data privacy, and intellectual property;
e. post any business opportunity that requires an upfront or recruitment fee, or requires recruitment of other members, sub-distributors or sub-agents; or
f. post jobs on Taqadam for modelling, acting, talent or entertainment agencies or talent scouting positions.
4.5.3. The QLA reserves the right to remove any job posting or content from Taqadam which, in the reasonable exercise of the QLA’s discretion, does not comply with the above Terms, or that the QLA believes is not in the best interest of the QLA and/or Taqadam.
4.6. CV Database
4.6.1. The CV Database is the area within Taqadam where candidates upload, and employers view or otherwise use, candidate CVs. You shall use the CV database in accordance with all applicable privacy and data protection laws, and You agree that You shall not further disclose any of the data from the CV database to any third party, unless You have been authorised to do so by a candidate, or You are using the CV explicitly for employment purposes.
4.6.2. You shall take appropriate physical, technical, and administrative measures to protect the data You have obtained through the CV database from loss, misuse, unauthorised access, disclosure, alteration or destruction.
4.6.3. Data and information obtained from the CV database shall not be used:
a. to make unsolicited phone calls or faxes or send unsolicited mail, email, or newsletters to candidates or to contact any individual unless they have agreed to be contacted (where consent is required or, if express consent is not required, who has not informed You that they do not want to be contacted);
b. to send emails or text messages or make phone calls to candidates that the QLA in its sole discretion determines to be excessive in frequency or related to job posts that are irrelevant to the work history or location of, or unlikely to be of interest to, the candidate contacted;
c. for any purpose other than as an employer seeking employees, including for example to advertise promotions, products, or services to any candidates;
d. to source or to contact candidates in relation to career fairs and business opportunities prohibited by these Terms; or
e. take any other action that is determined in the QLA’s sole discretion to be inconsistent with these Terms, misleading or incomplete, or in violation of any law, code, rule, or regulation.
4.6.4. To ensure a safe and effective experience for all Users, the QLA reserves the right to limit the amount of data (including CV views) that may be accessed by You or the number of contacts, emails or messages You may make or send through Taqadam.

5. Additional Terms For Candidates

5.1. When You register with Taqadam, You will be asked to create a Profile or to log in with any security credentials provided by Taqadam, and to provide Taqadam with certain information including, without limitation, name, postal code, career and education level and a valid email address. Any Profile that You submit must be accurate and describe You, an individual person.
5.2. You understand and acknowledge that You have no ownership rights in Your account and/or Profile and that if You cancel Your account, or if Your account is terminated by QLA in its sole discretion, all of Your account information from Taqadam, including but not limited to your Profile, CVs, cover letters, saved jobs, and contacts will be marked as deleted in, and may be deleted from, the Taqadam databases and will be removed from any public area of Taqadam.

6. Warranty Disclaimer

To the fullest extent possible by law, the QLA does not warrant that Taqadam or any of its services will operate error-free or that Taqadam and its servers are free of computer viruses or other harmful mechanisms. Taqadam and the Taqadam Content are provided on an “as is” basis without any warranties of any kind. The QLA, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including fitness for a particular purpose and non-infringement. The QLA makes no warranties about the accuracy, reliability, completeness, or timeliness of the Taqadam Content, services, software, text, graphics, links, or User Content.

7. Limitation of Liability

7.1. Taqadam acts as a platform for (i) employers to post job opportunities and search for and evaluate job candidates, and (ii) candidates to post CVs and Profiles and search for and evaluate job opportunities. The QLA and/or Taqadam does not screen or censor the listings, including the Profiles offered. The QLA and/or Taqadam is not involved in, nor does either control, the actual transaction between employers and candidates.
7.2. As a result, neither the QLA nor Taqadam is responsible for User Content, the quality, safety or legality of the jobs or CVs posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings and neither the QLA nor Taqadam makes any representations about any jobs, CVs or User Content on Taqadam.
7.3. Your use of Taqadam is entirely at Your own risk, and in no event will the QLA, its members, service providers, agents or employees be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or any other monetary or other damages, fees, fines, penalties, or liabilities (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of or relating to Taqadam, or Your use or inability to use the content on Taqadam, even if the QLA has been notified orally or in writing of the possibility of such damage.
7.4. The QLA cannot and does not confirm that each User is who they claim to be. The QLA does not and cannot be involved in User-to-User dealings or control the behaviour of participants on Taqadam. In the event that You have a dispute with one or more Users, to the fullest extent permitted by law You release the QLA (and its members, service providers, agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
7.5. While the QLA reserves the right in its sole discretion to remove User Content, job postings, CVs or other material from Taqadam from time to time, neither the QLA nor Taqadam assumes any obligation to do so and to the extent permitted by law, they disclaim any liability for failing to take any such action.
7.6. Your sole and exclusive remedy for dissatisfaction with Taqadam is to stop using Taqadam. The QLA will not be responsible in any way for loss or damage that results from Your failure to abide by these Terms or other applicable rules, or from any technical, human or software errors or failures found within Taqadam. The QLA may use third party providers in providing and administering Taqadam. The QLA is not liable for the acts or omissions of any such third party service providers. Users also must comply with any third party provider’s terms.

8. Indemnification

You agree to indemnify, defend, and hold harmless the QLA and its members, service providers, agents, and employees from and against any claims, actions, lawsuits or demands, including without limitation any and all losses, damages, liabilities, and costs of every nature (including expenses and reasonable attorneys’ fees and costs) alleging or resulting from (i) any User Content or other material You provide or post to Taqadam, (ii) Your use of Taqadam or the Taqadam Content, or (iii) Your breach or alleged breach of these Terms.

9. Links

9.1. You may link to Taqadam’s homepage provided You do so in a way that is legal and does not damage the reputation of the QLA and/or Taqadam, and that You do not suggest any form of association, approval or endorsement on the part of the QLA and/or Taqadam where none exists. You also must not establish a link from any website that is not owned by You.
9.2. Where Taqadam contains links to other sites and resources provided by third parties, such links are provided for Your information only. The QLA has no control over the contents of those sites, data or resources and accepts no responsibility for them or for any loss or damage that may arise from Your use of them. Your use of any such linked website is at Your own risk. The inclusion of any third-party link does not imply endorsement by the QLA. You understand that when going to a third-party website, that site is governed by the third party’s privacy policy and terms of use, and the third party is solely responsible for the content and offerings presented on its website.

10. Term And Termination

10.1. These Terms will remain in full force and effect while You are a User of Taqadam. The QLA reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to the removal of Your User Content from Taqadam and immediate termination of Your account with, or ability to access, Taqadam upon any breach by You of these Terms.
10.2. The QLA may, in its sole discretion, terminate your use of Taqadam at any time. The QLA reserves the right to change, suspend or discontinue all or any aspect of Taqadam at any time without prior notice.

11. Governing Law And Dispute Resolution

11.1. You agree that these Terms and any dispute between You and the QLA arising out of them shall be governed by, and construed in accordance with the laws of the State of Qatar.
11.2. If any dispute arises out of or in connection with these Terms which is not resolved in an amicable way, You and the QLA shall refer such a dispute to arbitration under the rules of arbitration in effect of the Qatar International Centre for Conciliation and Arbitration (“QICCA”) by a single arbitrator, agreed upon by the parties or, failing such agreement by the parties, appointed by QICCA, whose decision shall be final and binding and shall be issued within 6 months from the date of his appointment; or, at the option of the QLA, through the competent courts of Qatar, to which jurisdiction You and the QLA exclusively submit.
